The study , titled "Situation and Barrier Analysis of Women with Disabilities in Accessing Justice for VAWG," delves into the experiences of women with disabilities concerning access to justice for violence against women and girls (VAWG). The research identifies the barriers faced by these women in accessing justice at various levels through in-depth analysis. It examines the existing justice mechanisms for women with disabilities and the challenges they confront. The study compiles and analyzes instances where women with disabilities were denied access to justice, shares success stories, and proposes approaches to address these barriers. The report also provides recommendations to bridge gaps in existing laws, policies, and services, facilitating evidence-based advocacy for the rights of women with disabilities within justice mechanisms.

“Appeal of Women with Disabilities”

Persons with disabilities have always been behind other people in the world. Even global statistics show that the number of persons with disabilities has increased in poor and least-developed countries. Being unable to meet even their basic needs, they are forced to live in extremely marginalized situations. As they are deprived of access to education, health and reproductive health, and engagement in economic activities, they are forced to live in extreme poverty. Women are four times more likely to be with disability due to poverty, hunger, war, sexual violence, lack of easy access to health services, etc. Women and girls with disabilities are deprived of sexual and reproductive health facilities, but at the same time they are also victims of sexual violence and rape, but because they are not able to get justice, they are forced to suffer further discrimination and contempt. The fact they are victims of gender discrimination has been shown by the UN and other global reports.

The UNCRPD was issued for States Parties in 2006 to ensure the rights of persons with disabilities. The Sustainable Development Goal 2030 has given a clear mandate that no one should be left behind in the development process, while the UNESCAP has already issued a 10-year-decade strategy plan for the Asia Pacific and implemented it. That is why the obligation to prioritize the rights of persons with disabilities should be the responsibility of all state countries, UN agencies, international partner organizations, the private sector, civil society, all three tiers of government, including the media.

 

  • Special laws should be made for the protection of women and girls with disabilities and access to justice for victims of violence. In addition, judicial bodies such as courts, police, and judicial structure committees should be made responsible, including legal capacities.
  • In order to ensure the human rights of persons with disabliiteis, state services should be provided in a human rights friendly framework and the investment of the donor agencies should be increased.
  • Keeping in mind the fact that most human rights of persons with disabilities have been violated, a framework for inclusion of disability should be created in all clusters of inclusion and at all stages of development.
  • In the context of making the world technology-friendly, easy-to-use disability friendly technology should be developed to make it accessible to persons and communities with all kinds of disabilities, and the information communication framework should be made friendly. Also, sexual violence caused by technology should be given focus.
  • In order to end the negative effects of climate change, policies and laws should be amended and special laws should be created to include access and inclusion for women and girls with disabilities.
  • The sexual and reproductive health rights of women and girls with disabilities should be ensured.
  • There should be representation of youth with disabilities at all levels and structures of the state.
  • All government and public structures should be disability friendly, as well as women, children, and senior citizen-friendly.
  • Considering the fact that women, and persons with disabilities are present in all castes, race, religions, gender and region, participation and representation from an interdisciplinary angle at the public and political levels should be ensured.
  • Entrepreneurship and economic empowerment of women with disabilities and their parents should be promoted by developing accessible production patterns for livelihood.
